TERMS OF SERVICE


 Terms of Agreement:

1. Snapp Photo Booth will arrive at event venue approximately 30 minutes before scheduled rental start time to setup equipment and make sure that everything is operational.

2. It is the sole responsibility of the client to secure permission of the event venue for Snapp Photo Booth to setup and operate the Photo Booth at this event. The Photo Booth is approximately 4ft by 7ft, and requires access to a 120-volt electrical outlet. The client is responsible to inform Snapp Photo Booth of any restrictions at the site that may affect the setup or operation of the Photo Booth and/or Snapp Photo Booth’s ability to adequately perform their duties. The client understands that such restrictions may adversely affect the overall experience and/or quality of photos, and that Snapp Photo Booth is not responsible for the consequences of such restrictions.

3. Snapp Photo Booth takes the utmost care regarding equipment function, photo quality, and printing. However, due to the nature of technology, some downtime may occur. Snapp Photo Booth guarantees its equipment to be operational at least 80% of the scheduled rental time, and will refund a pro-rated amount of the rental price for any downtime beyond this caused by equipment malfunction. 

4. In the event Snapp Photo Booth fails to comply with the terms of this agreement, Snapp Photo Booth will only be liable for funds received.

5. Client agrees to indemnify Snapp Photo Booth against any and all liability from any claims, actions, suits, costs, damages or liabilities including but not limited to liability for personal injury of any person at the event, and/or property damage.

6. Snapp Photo Booth reserves all rights to the photographs captured during event and may be used for demonstration, publication, or other purposes. Original media and copyrights remain the exclusive property of Snapp Photo Booth. 

7. Any individual aspects or particular requests should be made prior to your signing this agreement.

8. This agreement incorporates the entire understanding of the parties. Any modifications of this agreement must be in writing and signed by both parties. 

9. This agreement shall be governed by the law of the state of California. 

10. The total price for the above services and product(s) is (package price). Payments shall be due at the following times: Payment is made before The Event date shall be defined. If The Event is rescheduled. Canceled Events must be rescheduled within 30 days of notice of cancellation in order to re-apply retainer(s).

11. If The Event is canceled, the Client must notify Snapp Photo Booth of his/her desire to cancel the contract, and upon receipt of that information Snapp Photo Booth will provide Client with a cancellation form. This form must be filled out in its entirety and sent to Snapp Photo Booth by certified mail, return receipt. Otherwise, the Client shall be responsible for the payment schedule as set forth above. Rescheduled events shall be subject to standard pricing in effect on the date to which the event has been rescheduled, and any pricing changes shall be documented in a separate addendum. 

12. If Snapp Photo Booth cancels the contract due to illness or a non-compliant Client (Client violates any terms of the Contract, Snapp Photo Booth may refund all or a portion of the fees already received. Any fees paid for services/products already completed will not be refunded.

13. Any failure to make timely payments may result in cancellation of this contract. Snapp Photo Booth will make every attempt to provide notice to Client before cancellation occurs.
